Clearing drains as a tenant, who should pay?
We are renting a property and recently had a blockage with water spilling through the inspection chamber and manhole cover. Dynorod came round to unblock and put a camera through. Turned out that 12 meters from the manhole in to next property, there is a brick in the drain. Dynorod recommended that we speak with next door to have them lift up their inspection chamber in their garden and remove the brick.
My problem is, we have already forked out the bill, do we have to lump it? Or do we try and get next door to pay (which may be a mission)? Or do we pass on to the landlord and it's up to them?
All in all, where do we stand?
Usually, if there is a problem with a rented property that wasn't your fault, it's up to the landlord pay for any damages/repairs. You shouldn't have had to pay for that and you definitely don't have to pay for them to go to your neighbor's house and fix the problem on their end. Your neighbors shouldn't have to pay either unless they own, otherwise their landlord should share half of the costs involved only if it's a problem to them as well. If the landlord doesn't feel like paying for the damages and they were not your fault, you can always take them to court. Don't pay anymore rent until everything is resolved. Assuming you have a rental agreement and aren't living month to month you have rights when it comes to these things. I live in NY and here people are always battling with their landlords regarding repairs. Hope this helps!!
